Welcome to Rega Stays! These Terms and Conditions govern your use of our services and your stay at our short-term rental properties. By booking a stay or using our property management services, you agree to comply with these Terms and Conditions.


Introduction


Rega Stays ("we," "us," "our") provides short-term rental management services to property owners and offers short-term rental accommodations to guests wishing to vacation in the Branson, MO area. These Terms and Conditions apply to all property owners who engage our management services and all guests who stay at our properties.


Property Management Services


For property owners who enlist Rega Stays for property management services, the following terms apply:

  • Services Provided: We manage all aspects of the short-term rental process, including guest communication, property marketing, cleaning coordination, property maintenance, and financial reporting.
  • Property Maintenance: Rega Stays ensures that properties are well-maintained and ready for guest use. Property owners must allow access to the property for regular maintenance and repairs.
  • Fee Structure: Rega Stays charges a management fee based on a percentage of the rental income or a flat fee as agreed upon in the management contract.
  • Owner Responsibilities: Property owners must provide accurate and up-to-date information about their properties and ensure that they meet all local and legal requirements for short-term rentals.
  • Termination of Services: Either party may terminate the management agreement by providing a 30-day written notice unless otherwise specified in the management contract.


Guest Reservations and Bookings


For guests staying at a Rega Stays property, the following terms apply:

  • Reservation Confirmation: Reservations are confirmed upon receipt of a booking confirmation email. Full payment is required prior to check-in unless otherwise agreed upon.
  • Check-In/Check-Out Times: Check-in times begin at [insert time], and check-out times are by [insert time]. Early check-in or late check-out may be available upon request, subject to availability.
  • Payment Terms: Full payment is required upon booking. Accepted payment methods include credit card, debit card, or other payment platforms as specified on the booking platform.
  • Security Deposit: A refundable security deposit may be required for certain properties to cover potential damages or violations of these Terms and Conditions.
  • Cancellations and Refunds: Cancellations must be made in accordance with the cancellation policy specified at the time of booking. Refunds will be processed based on the specific property’s cancellation policy.
  • Maximum Occupancy: Each property has a maximum occupancy limit, which will be provided at the time of booking. Exceeding the occupancy limit may result in additional fees or immediate termination of the rental agreement without a refund.
  • Guest Responsibilities: Guests must keep the property in good condition, abide by local laws and regulations, and follow any property-specific rules outlined in the guest welcome guide

Use of the Property


  • Property Use: Guests may use the property solely for residential, non-commercial purposes during their stay.
  • Noise and Nuisance: Guests must respect the peace and privacy of neighbors and other guests. Excessive noise or disruptive behavior may result in termination of the rental without a refund.
  • Pets: If pets are allowed at a property, it will be specified in the listing. Guests must follow all pet policies, and additional fees may apply for bringing pets to the property.
  • Damage and Loss: Guests are responsible for any damages caused to the property during their stay, including but not limited to damage to furniture, appliances, and other amenities. Any damage must be reported immediately, and repair or replacement costs will be deducted from the security deposit or billed to the guest.
  • Prohibited Activities: Illegal activities, smoking (unless otherwise specified), and any actions that could cause damage to the property or violate local laws are strictly prohibited.


Liability and Disclaimers


  • Liability for Damages: Rega Stays is not liable for any damages or injuries that occur during a guest’s stay. Guests are advised to take proper precautions and are responsible for the safety and security of themselves and their belongings.
  • Force Majeure: Rega Stays will not be liable for any failure to perform its obligations under these Terms and Conditions if the failure results from events beyond its control, including but not limited to natural disasters, strikes, lockouts, or other force majeure events.
  • Property Condition: While Rega Stays ensures properties are maintained to high standards, we make no warranties, express or implied, about the condition or suitability of any property.


Termination and Modification of Services


  • Termination by Rega Stays: Rega Stays reserves the right to terminate any booking or management agreement at its discretion if the guest or property owner violates these Terms and Conditions.
  • Modifications to Terms: Rega Stays reserves the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting, and continued use of our services will constitute acceptance of the revised Terms and Conditions.


Governing Law and Dispute Resolution


These Terms and Conditions are governed by the laws of the State of Missouri. Any disputes arising from or relating to these Terms and Conditions shall be resolved through negotiation or mediation. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts in Missouri.
